The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Significance of Wording

 

The applicant must indicate whether the wording “SILVER” has any significance in the relevant trade or industry or as applied to the goods, including whether the term identifies the color of the paintballs, whether the term identifies a grade designation, or has any other significance.  37 C.F.R. §2.61(b).  Applicant should note that depending on its response, additional issues may arise.

 

Entity Designation

 

Applicant must specify the names and the national citizenship (for individuals) or the U.S. state or foreign country of organization or incorporation of the general partners, as appropriate.  37 C.F.R. §2.32(a)(3)(iii); TMEP §§803.03(b) and 803.04.
