The assigned examining attorney has reviewed the above-referenced application and determined the following.

 

No Conflicting Marks Noted

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d).  15 U.S.C. § 1052(d); TMEP § 1207.01 et seq.

 

Duplicate Registration

The examining attorney has searched the Office records and refuses registration of the applicant’s mark on the basis that it is identical in every way to the applicant’s existing mark in U.S. Registration No. 2294806.  See the enclosed registration.   It is the practice of the Office to refuse to issue registrations that are in all respects identical to each other.  TMEP § 703.  If the cited registration will be canceled under Section 8, the applicant may so advise the Office.

 

If a the owner of a registration who has not timely filed a §8 affidavit or §9 renewal application wants to expedite cancellation or expiration of its own registration, the owner may request in writing that the Office expedite the processing of the cancellation or expiration of the registration. The request should be signed by the owner or the owner's attorney, and should specifically state that no §8 affidavit or renewal application was filed on or before the end of the grace period. Such a request should be directed to the Post Registration Section.

 

Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.
