This application has been withdrawn from publication because the office has determined that the identificaiton of goods is indefinite. Therefore, the following requirement is ow issued.
The application identifies goods and/or services that are classified in at least 3 classes; however, the fees submitted are sufficient for only 1 class. In a multiple-class application, a fee for each class is required. 37 C.F.R. §2.86(a)(2); TMEP §§810-810.01 and 1403.01.
Applicant must either: (1) restrict the application to the number of class(es) covered by the fee already paid, or (2) pay the required fee for each additional class(es). 37 C.F.R. §2.86(a)(2); TMEP §§810.0l, 1401.04, 1401.04(b) and 1403.01.
The filing fee for adding classes to an application is as follows:
(1) $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; and
(2) $375 per class, when the fees are submitted with a paper response.

If the “holiday ornaments” are not “tree” ornaments, then they are classified according to the material content of the ornaments, e.g., plastic ornaments in class 20 and ceramic ornaments in class 21. The applicant must either specify that the goods are holiday tree ornaments in class 28, or the applicant must amend the classification and identification of goods to include the additional class(es).
The applicant may amend the classification and identification of goods as follows, if accurate:
Class 20: Plastic holiday ornaments;
Class 21: Ceramic holiday ornaments:
Class 28: Holiday tree ornaments, toy figures, toy vehicles, toy figure play sets, toy vehicle play sets, and accessories for all of the foregoing
Combined Applications
If applicant prosecutes this application as a combined, or multiple-class application, applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
(1) Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order; and
(2) Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).
