AMENDMENT(S) AUTHORIZED: As authorized by Jeffrey Van Hoosear on November 14, 2006, the application is amended as noted below. If applicant disagrees with or objects to any of the amendments below, please notify the undersigned trademark examining attorney immediately. Otherwise, no response is necessary. TMEP §707.
The applicant submitted a color claim as part of the original application, claiming the color gray as a feature of the mark. However, this Office requires that applications for color marks also contain a separate description of where the color appears in the mark. 37 C.F.R. §2.52(b)(1). While in this case the entire mark is shown in the claimed color, a separate description statement is still required.
Accordingly, the following color description statement will be made of record:
The color gray appears in the lettering “BOE.”
