OFFICE SEARCH: The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.
AMENDMENT: The trademark examining attorney is amending the application as follows. No prior approval or authorization from applicant or applicant’s attorney is required. TMEP §707.02. Please advise the undersigned immediately if there is an objection to the amendment. Otherwise, no response is necessary. TMEP §707.
If the identification of goods or services has been amended, please note that any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e).
The identification of goods in Class 9 is acceptable. The identification of goods in Class 7 is amended to correct a typographical error, namely, to replace the hyphen with a comma. In this regard, the identification is amended to read as follows. TMEP §1402.01(e).
Food slicing machines, food cutting machines, vegetable peeling machines, electric food mixers; attachments for electric food mixers, namely, meat and food choppers, fruit and vegetable slicers, knife and tool sharpeners, beaters, knives, dough hooks, oil and liquid dispensers, juice extractors, and tray supports in the nature of holders for holding the aforementioned electric food mixer attachments onto electronic food mixers; and food machine supporting stands, in Class 7.
Please also note that applicant’s withdrawal of the distinctiveness claim is accepted.
