Applicant did not respond to the previously issued Office action within six months of the mailing date of the action.  The outstanding refusal(s) or requirement(s) applied to only a portion of the application.  Therefore, a portion of the application is abandoned.  37 C.F.R. §2.65(a). 

 

The application will proceed with the following identification:  the services in classes 37, 41 and “computer services, namely, creating and maintaining web sites for others; computer software design for others; computer software design; computer services, namely, providing search engines for obtaining data on a global computer network; computer systems analysis; rental of computers; testing of new products for others” in class 42.  The remaining portion of the identification that was the subject of the partial refusal or requirement will be deleted from the application. [Classes 9, 35 and 38 and “computer services, namely, providing databases featuring general and local news” in class 42”

 

Applicant may petition to revive the portion that abandoned if the failure to respond was unintentional.  A petition must be filed within two (2) months of the mailing date of this action; it may be filed online at http://www.gov.uspto.report/teas/index.html.  37 C.F.R. §2.66; TMEP §1714.01(d).
