DESCRIPTION OF SERVICES

 

The “electronic publishing services’ in the identification of services needs clarification because it does not state the subject matter of the online publications to be published.  Applicant must amend this wording to specify the common commercial or generic name for the services.  If there is no common commercial or generic name for the services, then applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s).  TMEP §1402.01.  The applicant may amend to the following, if accurate:

 

Class 41:            electronic publishing services, namely, publication of text and graphic works of others online featuring (indicate the subject matter of the works); publishing of books, magazines and web magazines

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §§1402.01 and 1402.03(a).  Therefore, the applicant may only amend to include those goods or services that are within the scope of the goods and services recited in the present identification.
