This letter responds to the applicant’s communication filed on February 26, 2007.
The Final refusal to register as to the identification of goods for International Class 9 is continued.
Identification of Goods
The identification of goods is unacceptable as indefinite. The applicant may adopt the following identification, if accurate: Personal computer accessories and equipment, namely, keyboards, numeric keypads, memory boards, USB memory keys, computer mice, CD drives, DVD drives, hard drives, headsets, diskette drives, port expanders, wireless LAN adapters, wireless LAN access points and computer communication equipment, namely, wireless telephones, International Class 9. TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
All other requirement previously set forth have been satisfied.
