The assigned examining attorney has reviewed the referenced application and determined the following.

SEARCH OF OFFICE RECORDS

 

The examining attorney has searched the Office records and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

IDENTIFICATION OF GOODS/RECITATION OF SERVICES

 

The identification of goods/recitation of services is unacceptable as indefinite.  The applicant must amend the wording by clearly and specifically identifying the goods or services.  As worded it is unclear if the applicant is offering goods or services, and thus is potentially identifying goods or services in multiple classifications.  The applicant may amend the identification to the following, if accurate:  TMEP §1402.01.

 

Computer software for simulated tracking, locating and monitoring of aircraft services, in International Class 009.

 

Providing online non-downloadable computer programs and software for simulation of aircraft tracking, in International Class 042.

 

Please note that, while an application may be amended to clarify or limit the identification/recitation, additions to the recitation are not permitted.  37 C.F.R. Section 2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods/services that are not within the scope of the goods/services listed in the present identification/recitation.
