This application was suspended pending the resolution of prior pending applications. One has matured into a registration and one has abandoned. Therefore applicant is informed as follows.
Section 2(d) - Likelihood of Confusion Refusal
The examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the applicant’s mark, when used on or in connection with the identified goods/services, so resembles the mark in U.S. Registration No. 3182061 as to be likely to cause confusion, to cause mistake, or to deceive. TMEP §§1207.01 et seq. See the enclosed registration.
Registration No. 3182061 is for the mark HOME PROJECT MIX on the Supplemental Register with MIX disclaimed for use on Dry concrete products, namely, cement and aggregate composed of stone particles for domestic, commercial or industrial use. Applicant’s proposed mark is PROMECT MIX for use on MIXTURES OF CEMENT, SAND AND AGGREGATE, CEMENT, SAND AND MORTAR. The marks and the goods are confusingly similar and consumers may be confused as to the source of the goods.
The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion. Instead, they need only be related in some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source. On-line Careline Inc. v. America Online Inc., 229 F.3d 1080, 56 USPQ2d 1471 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Section 2(e)(1) - Descriptive Refusal
The examining attorney repeats the refusal to register the goods on the Principal Register because the proposed mark merely describes the goods/services. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); TMEP §§1209 et seq.
See the attached evidence from the Google research database. The goods are a MIX (of cement used for a PROJECT), thus a PROJECT MIX.
