The assigned trademark examining attorney has reviewed the application and the statement of use and has determined the following:

 

Name and Entity

 

Applicant’s name and entity type are specified inconsistently in the application, and clarification is required.  The name of a limited liability company appears in the section of the application intended for the trademark owner’s name, but the entity type is set forth as a corporation.  TMEP §803.03.

 

If applicant is a limited liability company, then applicant must change the “Legal Entity Section” of the application to the following, if accurate:  “Riverside Hydronics, LLC, a limited liability company organized under the laws of the state of Texas.”    TMEP §803.03(h).

 

Alternatively, if applicant is in fact a corporation, the correct name of the corporation should be set forth in the “Owner Section” of the application.  TMEP §§803.02(c) and 803.03(c).
