The assigned examining attorney has reviewed the referenced application and determined the following:
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
If applicant is the owner of U.S. Registration Nos. 2001714, 2663562, 2757769 and others, then applicant must submit a claim of ownership. 37 C.F.R. §2.36; TMEP §812. The following standard format is suggested:
Applicant is the owner of U.S. Registration Nos. 2001714, 2663562,[1] 2757769 and others.
Please note the following: The issue raised in this Office action may be resolved by emailing the undersigned examining attorney (matthew.pappas@uspto.gov) and authorizing an entry consistent with the suggestion in this Office action. Please include the wording “EXAMINER’S AMENDMENT” and the serial number in the subject field of the email. Upon emailing the examining attorney and authorizing the entry, no further response is necessary and an examiner’s amendment will be promptly issued.
Whether applicant chooses to respond via regular mail, facsimile or electronic mail, applicant should submit its response using only one of these means of communication. Duplicate responses will delay the prosecution of the application.
Applicants may now file requests to change the correspondence address electronically on up to 20 applications at one time. The Office encourages applicants to use this time-saving form, available online at http://www.gov.uspto.report/teas/index.html.
The following legal authorities govern the processing of trademark and service mark applications by the Office: The Trademark Act, 15 U.S.C. §§1051 et seq., the Trademark Rules of Practice, 37 C.F.R. Part 2, and the Office’s Trademark Manual of Examining Procedure (TMEP) (4th ed., 2005), available on the United States Patent and Trademark Office web site at http://www.gov.uspto.report/main/trademarks.htm.
Effective January 31, 2005 and pursuant to the Consolidated Appropriations Act, 2005, Pub. L. 108-447, the following are the fees that will be charged for filing a trademark application:
(1) $325 per international class if filed electronically using the Trademark Electronic Application System (TEAS); or
(2) $375 per international class if filed on paper
These fees will be charged not only when a new application is filed, but also when payments are made to add classes to an existing application. If such payments are submitted with a TEAS response, the fee will be $325 per class, and if such payments are made with a paper response, the fee will be $375 per class.
The new fee requirements will apply to any fees filed on or after January 31, 2005.
