This letter is in response to applicant’s communication filed on 11/25/05.
Applicant’s amended recitation is rejected and applicant must also respond to a new issue regarding the drawing.
Recitation of Services in Class 042
Applicant’s amended recitation reads:
“Technology evaluation and protection services, namely, intellectual property consultation; assisting in identifying scope of technologies; advising inventors; and conducting negotiations, including licensing negotiations, between organizations regarding intellectual property and related technologies”,
The placement of the semi-colons make the amendment indefinite. All of the services should related back to the IP consulting services.
Applicant may adopt the following identification of services, if accurate: “Technology evaluation and protection services, namely, intellectual property consultation featuring assisting in identifying scope of technologies, advising inventors, and conducting negotiations featuring licensing negotiations between organizations regarding intellectual property and related technologies” TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods and services recited in the present identification.

Drawing
Applicant must submit a new drawing showing the entire mark clearly and conforming to 37 C.F.R. §§2.52, 2.53(c) and 2.54(e). The current drawing is not acceptable because the drawing displays the mark as a partially open, scalloped-edged sunburst with four vertical lines centered in the background. However, the drawing page seems to have faded out the top left corner of the sunburst when it was photocopied.
Please submit a new drawing page where the mark is consistent with the specimen.
