EXPLANATION OF FILING

In the application that matured into the present registration, the applicant was incorrectly and inadvertently identified as Nutrition Express Corp., a California corporation. The present registration then issued with Nutrition Express Corp. listed as the registrant.

The proper name of the applicant/registrant was and is Nutrition Express Corporation, which is a California Corporation. The usage of the abbreviation for the word "corporation" as opposed to the word itself was an inadvertent and minor clerical error.

As such, Registrant respectfully requests that the registration be amended to reflect the owner as Nutrition Express Corporation. This amendment is acceptable under TMEP 1201.02(c) (stating that minor clerical errors in identifying the applicant are correctable in applications) and TMEP 1609.10(b) (stating that "[a] registration can be corrected to cure an inadvertent error in the manner in which the owner's name is set forth," and referencing the standard laid out in TMEP 1201.02(c)).
