The assigned trademark examining attorney has reviewed the referenced application filed on July 22, 2004, and has determined the following.

 

No Conflicting Marks Noted

 

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods

 

The wording in the identification of goods is unacceptable as indefinite, with particular emphasis placed on the use of parentheses.  In the identification, the applicant must use the common commercial names for the goods, be as complete and specific as possible and avoid the use of indefinite words and phrases. If the applicant chooses to use indefinite terms, such as “accessories,” “components,” “devices,” “equipment,” “materials,” “parts,” “systems,” and “products,” then those words must be followed by the word “namely” and the goods listed by their common commercial names. TMEP 804 and 804.08(c).

 

The applicant may amend this wording to "Surgical and medical devices and instruments, namely catheters; permanent metal prosthesis for the treatment of the obstructive peripheral artery diseases and obstructive coronary artery diseases, namely, peripheral stents and coronary stents," if accurate, in Class 10.  TMEP section 1402.11.

 

For the applicant’s convenience, the Trademark Acceptable Identification of Goods and Services Manual on the office’s website at http://www.gov.uspto.report/web/offices/tac/doc/gsmanual/ offers a searchable list of acceptable identifications and classifications. The Manual is a useful resource and guide, but it is not an exhaustive list of every acceptable identification.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(a); TMEP section 804.09.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

 

Entity Type Unclear

 

Applicant must indicate the United States equivalent of its entity type or provide a description of the nature of the entity.  In the “Applicant’s Entity Type” section of the application, applicant currently identifies itself as a Societa a responsabilita limitata, which is unacceptable as a designation in the United States because it is not an English term.  TMEP §803.03(i).

 

Bases: Section 44(e) and 1(b)

 

Applicant must advise the trademark examining attorney whether applicant intends to rely solely on the foreign registration as the basis for registration.  The foreign registration alone may serve as the basis for obtaining a U.S. registration resulting from this application.

 

Unless applicant indicates otherwise, this Office will presume that the applicant wishes to rely on both Section 1(b) and Section 44(e) as the bases for registration.  In this case, although the application may be approved for publication, the mark will not register until an acceptable allegation of use has been filed.

 

Certificate of Registration Required

 

The applicant must submit a copy of the foreign registration including the renewal date of the registration.  If the foreign certificate of registration is not written in English, then applicant must provide an English translation signed by the translator.  See TMEP §§1004.01 and 1004.01(b).

 

The application does not presently contain a copy of the foreign registration.  An application filed under Trademark Act Section 44(e), 15 U.S.C. §1126(e), must include a true copy, photocopy, certification or certified copy of a foreign registration from the applicant’s country of origin.  Applicant’s country of origin must either be a party to a convention or treaty relating to trademarks to which the United States is also a party, or must extend reciprocal registration rights to nationals of the United States by law.  See TMEP §§1002.01 and 1004.

NOTICE:  FEE CHANGE   

 

Effective January 31, 2005 and pursuant to the Consolidated Appropriations Act, 2005, Pub. L. 108-447, the following are the fees that will be charged for filing a trademark application:

 

(1) $325 per international class if filed electronically using the Trademark Electronic Application System (TEAS); or 

 

(2)   $375 per international class if filed on paper

 

These fees will be charged not only when a new application is filed, but also when payments are made to add classes to an existing application. If such payments are submitted with a TEAS response, the fee will be  $325 per class, and if such payments are made with a paper response, the fee will be $375 per class.

 

The new fee requirements will apply to any fees filed on or after January 31, 2005.
