NOTICE OF SUSPENSION
This letter responds to applicant’s communication received on August 8, 2005, in which the applicant stated it wished to rely on the Section 44 basis and requested suspension. The applicant further stated that all other issues discussed in the prior Office Action of February 9, 2005 would be addressed upon submission of the foreign application. The applicant noted that Registration No. 2157269 has been cancelled. The examining attorney withdraws this registration as a bar under Section 2(d).
Action on this application is suspended pending receipt of a true copy, a photocopy, a certification, or a certified copy of a foreign registration from the applicant's country of origin. If the registration is in a foreign language, an English translation must be submitted. The true copy, photocopy, certification, or certified copy of the registration should be forwarded to the Examining Attorney as soon as possible. If the foreign application is abandoned, the Examining Attorney should be advised.
The Section 2(d) refusal with regard to Registration No. 2824463 (see previously attached copy), the identification and classification of goods and services requirement, and the drawing requirement are all maintained and continued.
