In response to a communication from the Examining Attorney dated February 2, 2005, reconsideration of this application is requested by Twentieth Century Fox Film Corporation ("Applicant") for the reasons stated below.

The Examining Attorney refused registration of Applicant's ROBOTS and Design mark covering goods in International Class 28 under Section 2(d) of the Trademark Act, 15 U.S.C. § 1052(d) on the grounds that Applicant's mark is likely to be confused with ROBOT (Reg. No. 993752) for "parlor game comprising a deck of playing cards for playing the game."

According to the USPTO database, the cited registration was cancelled on May 5, 2005. Therefore, since the cited registration has been cancelled, it no longer constitutes an obstacle to registration of this mark and Applicant respectfully requests that the citation be withdrawn.

Applicant believes the application is now in suitable form to proceed to publication and requests reconsideration of this refusal.
