Applicant responds to the Office Action mailed September 29, 2008 in connection with the above-identified application.   

 

AMENDMENT

            Please amend to above-identified application to include the following color claim and color location statement:

The colors blue, orange, black and white are claimed as features of the mark

The mark consists of the word "ProPresenter" superimposed over two quadrilaterals.  The wording appears in black outlined in white. The color orange appears in the obscured quadrilateral containing "PRO" and the color blue appears in the quadrilateral containing the word "PRESENTER."

 


REMARKS

CONFUSION IS NOT LIKELY

In the September 29, 2008 Office Action, the Examining Attorney continued the Section 2(d) refusal to register Applicant's mark under Section 2(d) of the Trademark Act, 15 U.S.C. § 1052(d), on the ground that Applicant's ProPresenter mark is likely to be confused with the mark disclosed in Registration No. 2,854,043.  Applicant respectfully disagrees with the Examining Attorney's conclusion and reports that Sigmatech, Inc., owner of the cited registration, also believes that confusion is not likely. 

After reviewing the differences between their respective marks, products, and customer bases, and in light of the fact that they have used their marks contemporaneously since 2001 without any actual confusion, Applicant and Sigmatech have concluded that the registration of Applicant's mark is not likely to cause confusion with Union's registered mark.  Attached hereto as Exhibit A is a copy of an Agreement executed by Sigmatech in which Sigmatech agrees that Applicant's use and registration of its ProPresenter mark is not likely to cause confusion with Sigmatech's mark.   Applicant respectfully submits that the Patent and Trademark Office ("PTO") should accept and defer to the judgment of the owner of the cited registration.  Sigmatech transacts in, competes in and monitors the market every day.  As such, it is in a better position to judge whether confusion between its mark and Applicant's mark is likely.  If Sigmatech believes that such confusion is unlikely, then the PTO should conclude likewise.  For the foregoing reason, and reasons previously presented, Applicant respectfully requests that the Examining Attorney withdraw the refusal to register Applicant's ProPresenter mark.   

SUBSTITUTE SPECIMEN

In the September 29 Office Action, the Examining Attorney also rejected Applicant's specimens because they did not show Applicant's mark in color and required Applicant to submit substitute specimens.  In response, Applicant submits herewith specimens, namely, screen shots showing the display of Applicant's mark when the software is in use.  These specimens show Applicant's mark in color.  Applicant further submits the declaration of Bradley A. Weston, attached hereto as Exhibit B, verifying that the substitute specimens were in use at least as early as August 5, 2003, the filing date of the application. 

COLOR CLAIM

In the September 29 Office Action, the Examining Attorney required Applicant to submit a color claim and a color location statement.  With the foregoing amendment, Applicant has satisfied that requirement. 

CONCLUSION

With the submission of this Response, Applicant believes that all outstanding requirements in connection with this application are now satisfied.  Further and favorable action resulting in publication of the mark is respectfully requested.   Although no fee is believed to be required, should any fee be required, please charge the required amount to deposit account no. 20-0778.
