This letter responds to the applicant's communication filed on August 16, 2004.
Descriptiveness
Registration was refused under Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1), because the subject matter for which registration is sought is merely descriptive of the identified goods.
The examining attorney has considered the applicant’s arguments and claim of ownership of prior U.S. Registration No. 815,582 carefully, and the refusal under Section 2(e)(1) is WITHDRAWN. However, the applicant must comply with the following requirement.
Disclaimer
The applicant must disclaim the descriptive wording “BLASTER” apart from the mark as shown. Trademark Act Section 6, 15 U.S.C. Section 1056; TMEP sections 1213 and 1213.02(a). The wording is merely descriptive because it indicates the common commercial name of the goods. The term “BLASTER” indicates the type of machine used in abrading and finishing. When utilized with sand as the abrasive medium, such machines are often referred to as “sandblasters.”[1] But such actions can be performed using similar machines for use with glass beads. Please see the attached evidence from HandsOnTools.com referring to a variety of power blasting devices as “BLASTERS.”
The computerized printing format for the Trademark Official Gazette requires a standard form for a disclaimer. TMEP section 1213.09(a)(i). A properly worded disclaimer should read as follows:
No claim is made to the exclusive right to use “BLASTER BEADS” apart from the mark as shown.
