This letter responds to applicant’s communication filed on October 24, 2005.

 

The refusal on the basis that the owner listed in the foreign registration, Guangzhou Jingfa Science & Technology Co., Ltd., differs from the owner listed on the U.S. application, Guangzhou Kingfa Science & Technology Development Co., Ltd., is continued pending applicant’s response to the following issue.

 

Identification of Goods

 

The amendment to the identification of goods has been entered.

 

The identification of goods for International Class 17 is acceptable.

 

Further review of the application reveals the need for the following two additional amendments to the identification of goods for International Class 1.  TMEP §1402.01.  The identification presently reads:  unprocessed artificial resins, synthetic resins for use in the manufacture of molding compounds, unprocessed plastics of all forms, fire extinguishing compositions, anti-static spray for electronic equipment, flame retarding compounds, chemical motor oil additive. 

 

Applicant must specify the industry or specific use for the “unprocessed artificial resins.”  Applicant may amend this language to “unprocessed artificial resins for a wide variety of fields.” The examining attorney apologizes to applicant for not indicating the necessity for clarification of this item in an earlier Office action.

 

Furthermore, “unprocessed plastics of all forms” should be amended to “unprocessed plastics in all forms.” 

 

Applicant may wish to consult the Office’s electronic Identification Manual of Goods and Services at www.uspto.gov for other suggestions as to acceptable language.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
