The assigned examining attorney has reviewed the referenced application and determined the following.

Search of Office Records

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.

Applicant’s Request to Divide

The applicant has requested that the application be divided. However, the application may proceed without dividing the application. The specimens for the services in Class 41 are acceptable. The only requirement which must be met is that the applicant provide a translation for the submitted specimens. Every word does not have to be translated, just the words necessary for the examining attorney to determine that the specimens are used in connection with entertainment services, namely, performances by a live musical band.
