The assigned examining attorney has reviewed the statement of use filed on 7/13/04 and has determined the following.

 

The statement of use as it pertains to class 9 is confusing.  The applicant indicates that applicant is using the mark on all the goods in the notice of allowance except “electric steam irons for domestic use.”  Electric steam irons for domestic use are the only goods listed in class 9. Thus it appears that applicant is deleting class 9.  The applicant submits the statement of use fees for 2 classes, classes 7 and 9.  The applicant has not submitted dates of use or a specimen for class 9.  If applicant intended to delete class 9, then applicant may indicate this for the record and request a refund.
