This letter responds to the applicant’s communication filed on September 7, 2004.
The disclaimer is accepted and entered. However, the following issue is maintained and made final.
Registration was refused because the proposed mark, as used on the specimen of record, does not function as a trademark to indicate the source of the identified goods. Trademark Act Sections 1, 2 and 45, 15 U.S.C. §§1051, 1052 and 1127; In re Remington Products Inc., 3 USPQ2d 1714 (TTAB 1987); TMEP §§1202 et seq.
The applicant argues that the proposed mark is used as a trademark, since it is shown with capital letters for the first letter of each term in the mark and is used with the trademark notation, TM. However, as acknowledged by the applicant, the proposed mark describes a feature of the goods. Furthermore, although shown with capital letters for the “E” in “elimination” and the “T” in “technology,” as well as a “TM,” the proposed mark does not look any different from the rest of the informational matter listed for the goods, such as “Instant brilliant light” and “Minimizes eye fatigue.” Therefore, as used, the proposed mark merely informs consumers that flicker elimination technology was used in making the goods, and it fails to serve a source indicating function for the goods on which it is used.
For the foregoing reasons, the refusal is made final.
If applicant fails to respond to this final action within six months of the mailing date, the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond to this final action by:
(1) submitting a response that fully satisfies all outstanding requirements, if feasible (37 C.F.R. §2.64(a)); and/or
(2) filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class (37 C.F.R. §§2.6(a)(18) and 2.64(a); TMEP §§715.01 and 1501 et seq.; TBMP Chapter 1200).
In certain circumstances, a petition to the Director may be filed to review a final action that is limited to procedural issues, pursuant to 37 C.F.R. §2.63(b)(2). 37 C.F.R. §2.64(a). See 37 C.F.R. §2.146(b), TMEP §1704, and TBMP Chapter 1201.05 for an explanation of petitionable matter. The petition fee is $100. 37 C.F.R. §2.6(a)(15).
