Dear Ms. Case:
I apologize for not getting this to you sooner today, I was tied up with an
errand this morning and got to this task a little later than expected.
As we discussed in our telephone conference on July 30, 2003, I wish to
speak with you regarding the Section 2(d) refusal for this mark based on the
identical mark TPS, Registration No. 2,417,793. That mark applies to wheel
bearings. I believe that the stream of commerce for the '793 registration
is separate from that of the Applicant's mark and have some information from
the Registrant's website which may be useful in the examination. If you are
available to return my call within the next two or two and one-half hours, I
would appreciate a call at 505/286-3511. Unfortunately, I will be leaving
the office at 2 p.m. Mountain time. I will be out of the office until
08/18/03. If we do not connect today, you can call Robert Becker at this
same number to discuss this matter. Thank you for your time and
consideration, and I do hope your arm is feeling a little less achy.
Best regards,
Katy Fain
