This letter responds to the applicant’s communication filed on June 13, 2003.
In the first Office action, a requirement was made for clarification as to the nature of the goods with which the applicant is using the mark in commerce and, specifically, requiring the applicant to list the common commercial names of the goods. The applicant has submitted what appears to be the goods with which it is using the mark in a non-continuous description. Therefore, the goods must be clarified. Therefore, the requirement for clarification of the specific goods with which the mark is used is maintained and made FINAL. TMEP §1402.01.
The applicant may adopt the following identification, if accurate:
Housewares, namely, bakeware, namely, baking dishes, molds, pans, racks, servers, stands and bakeware sets comprised of baking dishes and pans sold together as a unit; cookware, namely, casseroles, non-electric woks, frying pans, roasting pans, sauce pans, pots, pot lids, non-electric pressure cookers, double boilers, non-electric kettles, steams and cookware sets comprised of roasting pans, pots and pot lids sold together as a unit; barware, namely, stainless steel cocktail sets comprised of cocktail picks and shakers sold together as a unit; cook's tools, namely, serving forks and spoons, scoops and mixing bowls; utensils, namely, graters, skimmers, sieves, spatulas, strainers and turners; and containers for household and kitchen use not of precious metal, in International Class 21.
For the applicant’s information, please note that "measuring cups" would be classified in International Class 9, and "electric woks" would be classified in International Class 11.
Please note that the only appropriate responses to a final action are (1) compliance with the outstanding requirements, if feasible, (2) filing of an appeal to the Trademark Trial and Appeal Board, or (3) filing of a petition to the Director if permitted by 37 C.F.R. §2.63(b). 37 C.F.R. §2.64(a); TMEP §715.01. Regarding petitions to the Director, see 37 C.F.R. §2.146 and TMEP Chapter 1700. If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned. 37 C.F.R. §2.65(a).

FEE INCREASE EFFECTIVE JANUARY 1, 2003
Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.
Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
