The applicant may seek registration under the Trademark Act Section 2(f), 15 U.S.C. §1052(f), by claiming acquired distinctiveness through ownership of U.S. Registration Nos. 2064591 and 2288983. (***)  To do so, the applicant must provide a statement that the mark has become distinctive of the goods/services as evidenced by ownership of U.S. Registration Nos. 2064591 and 2288983 on the Principal Register for the same mark for related goods or services.  37 C.F.R. §2.41(b); TMEP §§1212.04 et seq.

 

***PLEASE NOTE:   The applicant’s statement of acquired distinctiveness (See the applicant’s communication dated October 25, 2002) contains a registration number that the applicant does not own, namely, Registration No. 2228982.  The applicant must provide the correct registration numbers, as cited by the examining attorney, above.

 

In addition, the prior examining attorney’s Office action dated May 10, 2002, contains a registration number that the applicant does not own, namely, Registration No. 2,288, 982.
