OFFICE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUES APPLICANT MUST ADDRESS:  On June 29, 2010, the trademark examining attorney and Robert Kenney discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

 

A.  Applicant’s Entity

 

The application identifies applicant as Lotte Shopping Co., Ltd., a “limited company,” which is not acceptable as an entity designation in the U.S. because South Korea is not a commonwealth country.  See TMEP §803.03(i).  Applicant must indicate the U.S. equivalent of its entity type or provide a description of the nature of the foreign entity.  See id.

 

B.  Translation of “LOTTE”

 

Applicant must submit an English translation of all foreign wording in the mark.  37 C.F.R. §2.32(a)(9); see TMEP §809.  In the present case, the wording “LOTTE” may require translation.

 

If “LOTTE” does have an English translation, the following translation statement is suggested:  “The English translation of LOTTE in the mark is [specify translation].”  TMEP §809.03.

 

C.  Description of the Mark

 

The description of the mark is accurate but incomplete because it does not describe all the significant aspects of the applied-for mark.  Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

Therefore, applicant must provide a more complete description of the applied-for mark.  The following is suggested:

 

The mark consists of the stylized word “LOTTE” underneath the Korean characters for that term.  The mark gives the appearance of having been stamped, with a half circle superimposed over the first Korean character and with blurring and fuzziness throughout.
