The trademark examining attorney is suspending action on the application for the reasons stated below.  See 37 C.F.R. §2.67; TMEP §§716 et seq. 

 

The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based.  TMEP §§716.04, 716.05.  Applicant will be notified when suspension is no longer appropriate.  See TMEP §716.04.

Since applicant's effective filing date is subsequent to the effective filing date of the above-identified application, the latter, if and when it registers, may be cited against this application in a refusal to register under Section 2(d) of the Trademark Act, 15 U.S.C. §1052(d).  See 37 C.F.R. §2.83; TMEP §§1208 et seq.  A copy of information relevant to this pending application was sent previously.

 

Applicant may submit a request to remove the application from suspension to present arguments related to the potential conflict between the relevant applications or other arguments related to the ground for suspension.  TMEP §716.03.  Applicant's election not to present arguments during suspension will not affect the applicant's right to present arguments later should a refusal in fact issue.  If a refusal does issue, applicant will be afforded 6 months from the mailing or e-mailing date of the Office action to submit a response.  15 U.S.C. §1062(b); 37 C.F.R. §2.62.

 

Notes:

 

• The refusal to register under Trademark Act Section 2(d), based on a likelihood of confusion with the mark in U.S. Registration No. 3005955 is continued and maintained.  The marks are identical, and the identification of services in the registration, namely, “business services providing visibility, manageability and predictability in managing energy consumption and associated cost” is broad enough to encompass a program for remotely monitoring customers’ propane tank levels to manage delivery of propane.  Where the marks of the respective parties are identical, there need be only a viable relationship between the relevant services to support a finding of likelihood of confusion.  See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202 (TTAB 2009); In re Thor Tech, Inc., 90 USPQ2d 1634, 1636 (TTAB 2009); In re Wilson, 57 USPQ2d 1863, 1867 (TTAB 2001); see also In re Shell Oil Co., 992 F.2d 1204, 1207, 26 USPQ2d 1687, 1689 (Fed. Cir. 1993).

 

• Applicant proposed amendment to the identification of services is accepted and made of record; and

 

• In light of applicant’s submission of an acceptable specimen of use demonstrating use of the proposed mark in connection with the identified services, the requirement therefor is deemed satisfied.
