The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

No Conflicting Marks Noted

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Multi-Class Application

The application identifies goods that are classified in at least 3 classes; however, the fees submitted are sufficient for only 1 class(es).  In a multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.

 

Therefore, applicant must either (1) restrict the application to the number of classes covered by the fee(s) already paid, or (2) submit the fees for the additional class(es). 

 

Identification of Goods

The wording “clothing” in the identification of goods must be clarified because it is too broad and could include goods in several international classes.  See TMEP §§1402.01, 1402.03.  Examples of acceptable identifications include the following:  “protective clothing” in International Class 9, “surgical gowns” in International Class 10, “pet clothing” in International Class 18, and “shirts, shorts and pants” in International Class 25.  Therefore, applicant must amend the identification to specify the type of clothing. 

 

If applicant’s clothing is classified in International Class 25, applicant should insert the word “namely,” after “clothing” and indicate the common commercial or generic names for the goods (e.g., shirts, pants, coats, dresses). 

 

In addition, the goods identified as “athletic cups and supporters” are classified incorrectly.  Applicant must amend the application to classify the goods in International Class 28.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).

 

Further, the wording “knee pads, ankle pads, shin pads” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.

Applicant may adopt the following, if accurate:

 

  • Orthopedic support bandage, namely, wearable pads for the knee, ankle and shins. (Class 10).
  •  Clothing, namely, {indicate goods by common commercial name, e.g., shirts, pants, socks, belts, footwear and headwear}; wristbands. (Class 25).
  • Athletic cups and supporters; pads used in {indicate sport, e.g., football}, namely, {indicate type of pads, e.g., knee pads; ankle pads; shin pads}. (Class 28).

 

TMEP §1402.01.

 

Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

 

Requirements of a Combined Application-Section 1(b)

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)        Applicant must list the goods and/or services by international class; and

 

(2)        Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).

 

See 15 U.S.C. §§1051(b), 1112, 1126(e); 37 C.F.R. §§2.34(a)(2)-(3), 2.86(a); TMEP §§1403.01, 1403.02(c).

 

The filing fee for adding classes to an application is as follows:

 

(1)        $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; or

 

(2)        $375 per class, when the fees are submitted with a paper response.

Significance of the Letters

Applicant must specify whether the letters “TPS” have any significance in the clothing or sporting wear trade or industry or as applied to the goods described in the application.  See 37 C.F.R. §2.61(b); TMEP §§808.01(a), 814.
