ISSUE/MAILING DATE: 3/5/2010
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03. The Examining Attorney spoke with applicant’s attorney regarding amendments to the Description of the Mark and Color Claim. The amendment is outlined below. However, upon a closer review of the drawing, it has come to the attention of the Examining Attorney that “TM” appears on the drawing. This should be deleted from the drawing. Accordingly, a requirement for a new drawing is made.
Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
New Drawing Required
The following amendments were made to the application by the authorization of Mr. Harold Kyle on March 5, 2010:
Description of the Mark
The description of the mark is amended to read as follows: “The mark consists of the word “Adora” in black on a green background surrounded by a black and white scroll design and the wording “Yours to adore” in black, all on a pink background.”
Color Claim
The colors green, pink, black and white are claimed as a feature of the mark.
