The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

Incorrect Classification of Services:

 

The services are classified incorrectly.  Applicant must amend the application to classify the services in International Class 36.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§1401.02(a), 1401.03(b).

 

Proper classification of goods and services is a purely administrative matter within the sole discretion of the United States Patent and Trademark Office.  In re Tee-Pak, Inc., 164 USPQ 88, 89 (TTAB 1969).

 

 

 

Indefinite Identification clause:

 

The wording “repair maintenance and support service plan… ” in the identification of services is indefinite and must be clarified because such language identifies services in a different international class.  See TMEP §1402.01.  Applicant must amend this wording to specify the common commercial or generic name for the services.  If there is no common commercial or generic name for the services, then applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

It appears that the applicant offers a prepaid support service plan for various consumer goods. If accurate, the recitation of services should be amended to read:

 

Prepaid consumer goods support service plans for repair and maintenance  covering consumer electronics, computers and related products, digital imaging products, home theater products, appliances, mobile pones, video game consoles, MP3 players and car electronics in international class 36.

 

Identifications of services can be amended only to clarify or limit the services; adding to or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.

 

Search Results:

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).
