The proceedings above pertain to registrations cited as a bar to applicant's registration under Section 2(d) of the Trademark Act. 15 U.S.C. §1052. Therefore, action is suspended pending the final disposition of these proceedings. See 37 C.F.R. §2.83; TMEP §§716.02(a), (c) and (d), 1208 et seq. Any refusals made under Section 2 are herein maintained. Applicant may submit documents pertaining to settlement/consent for review at any time, as discussed in the recent phone conference between the undersigned and applicant’s counsel.
The following refusal is continued and maintained:
Section 2(d) refusal re: RN 2,599,395 (applicant’s ID limitation considered insufficient to resolve issue presented as various types of golf equipment are commonly sold by a single source.)
The following refusals are withdrawn:
Section 2(d) refusals based on RN 2,588,960 (upon review of ID limitation); RN 3,095,970 and 3,107,094 (upon review of consent documents).
