EXPLANATION OF FILING

This is a request for the correction of the owner name.  The correct name of the owner is "Berghoff Restaurant Company of Delaware".

At the time of filing, the owner name was inadvertently listed as "Berghoff Restaurant Company of Delaware, Inc.".  The correct corporate name does not include ", Inc.".

This error occurred in good faith with no intent to deceive.
