The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Identification of Goods

 

THIS REQUIREMENT APPLIES ONLY TO THE GOODS/SERVICES SPECIFIED THEREIN:

 

The wording “online computer software” in the identification of goods is indefinite and must be clarified because it suggests services rather than goods (in a list of other goods) and because it does not specify the function of the software.  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “providing on-line downloadable software for use in __________ (specify function of the software),” in International Class 42.

 

The wording “application media stores” in the identification of services is indefinite and must be clarified because it does not clearly describe the nature of these services or how they are provided.  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  on-line retail stores services featuring downloadable application media, namely _______ (specify the type of media provided via applicant’s retail services),” in International Class 35.

 

The wording “handheld electronic units” in the identification of goods is indefinite and must be clarified because it does not specify a use for the goods (e.g., playing video games).  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “handheld computers,” in International Class 9.

 

The wording “handheld entertainment units” in the identification of goods is indefinite and must be clarified because it does not specify a particular use for these goods.  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “handheld units for ________ (describe a specific use, e.g., playing video games,” in International Class 9.

 

Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Failure to Respond – Abandonment of Specific Goods/Services

 

If applicant does not respond to this Office action within the six-month period for response, then the following goods and/or services will be deleted from the application:  online computer software; application media store; handheld electronic units; handheld entertainment units.  The application will then proceed with the following goods:  computers, namely, general purpose mobile computers and associated peripherals; computer software, namely operating systems and software user interfaces; mobile telephones; smart phones; personal digital assistants; personal media players.  37 C.F.R. §2.65(a).

 

Multiple Class Application

 

The application identifies goods and services that are classified in at least THREE classes; however, the fees submitted are sufficient for only ONE class.  In a multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.

 

Therefore, applicant must either (1) restrict the application to the number of classes covered by the fee(s) already paid, or (2) submit the fees for the additional class(es). 

 

The filing fee for adding classes to an application is as follows:

 

         (1)     $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; or

 

         (2)     $375 per class, when the fees are submitted with a paper response.

Response Guidelines

 

There is no required format or form for responding to an Office action.  The Office recommends applicants use the Trademark Electronic Application System (TEAS) to respond to Office actions online at http://www.gov.uspto.report/teas/index.html.  However, if applicant responds on paper via regular mail, the response should include the title “Response to Office Action” and the following information:  (1) the name and law office number of the examining attorney, (2) the serial number and filing date of the application, (3) the mailing date of this Office action, (4) applicant’s name, address, telephone number and e-mail address (if applicable), and (5) the mark.  37 C.F.R. §2.194(b)(1); TMEP §302.03(a).

 

The response must be personally signed or the electronic signature manually entered by applicant or someone with legal authority to bind applicant (i.e., a corporate officer of a corporate applicant, the equivalent of an officer for unincorporated organizations or limited liability company applicants, a general partner of a partnership applicant, each applicant for applications with multiple individual applicants).  TMEP §§605.02, 712.
