REMARKS
In response to the Examining Attorney’s assertion that the scope of the description of goods and services for the subject Application exceeds that which is recited in the Applicant’s Canadian Registration, Applicant has deleted the Class 44 services described as “medical diagnostic services, namely, medical diagnostic testing, monitoring and reporting services.” Applicant submits that the description of goods and services for the subject application, as amended, is sufficiently definite and now covers only those goods and services deemed by the Examining Attorney to be recited in its Canadian Registration.
Assuming all outstanding requirements have been met and the application is in condition for publication solely on the basis of Applicant’s ownership of its home country registration, the Examining Attorney is authorized to delete the separate intent to use basis in order that the application may proceed on the basis of the corresponding home country registration alone with the benefit of priority.
Notice to this effect is earnestly solicited. |
