| In response to Office Action dated July 27, 2011, Applicant respectfully submits the following.
The Examining Attorney has rejected Application Serial Number 77794439 for QUIDDITCH for use in connection with bed linens, namely, bed blankets in International Class 24 on the grounds that the trademark as used on the goods is merely a decorative or ornamental feature of the goods and does not function as a trademark to identify the Applicant’s goods under Sections 1, 2 and 45 of the Trademark Act. However, the Examining Attorney has stated that, if Applicant submits evidence showing that, the proposed mark would be recognized as a trademark through the Applicant’s use of the same with goods other than bed linens and blankets, this basis of rejection may be withdrawn. Applicant would direct the Examining Attorney’s attention to the fact that the Applicant’s QUIDDITCH trademark has also been used in a source identifying manner with the following goods:
Copies of representative specimens in support of the use of the QUIDDITCH trademark, in connection with the aforenoted goods, are enclosed for the Examining Attorney’s review as Exhibits 1-2. As evidenced by the Exhibits, the QUIDDITCH trademark is used and promoted in connection with goods other than bed linens namely, bed blankets in International Class 24. As such, it is respectfully submitted that the public would recognize Applicant as the secondary source or sponsor of the identified goods and the refusal of registration on the ground that the proposed mark is ornamental should be withdrawn.
CONCLUSION In view of the fact that the Applicant has resolved all of the substantive issues and informalities, it is respectfully requested that a Notice of Publication issue for the QUIDDITCH trademark under Section 12 of the Trademark Act, as amended.
