The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

General Partner Information Requirement

 

The names of the general partners in applicant’s partnership have not been provided in the application.  Therefore, applicant must specify the names, legal entities and national citizenship (for individuals) or the U.S. state or foreign country of organization or incorporation (for businesses) of all general partners.  37 C.F.R. §2.32(a)(3)(iii); TMEP §§803.03(b), 803.04.

 

Color Claim and Color Location Statement Amendment Requirement

 

Applicant has submitted a color drawing, but has not provided the required color claim and color location statement that describes the locations of all colors appearing in the mark accurately.  Applications for color marks must include both a list of the colors that are claimed as a feature of the mark and a description of where the colors appear in the mark.  37 C.F.R. §2.52(b)(1); see TMEP §§807.07(a) et seq.  Generic color names must be used to describe the colors in the mark, e.g., magenta, yellow, turquoise.  TMEP §807.07(a)(i)-(a)(ii).

 

Applicant must submit both a color claim and color location statement using the following format, and may adopt the following suggested claim and statement, if accurate:

 

(1)     Color claim:  “The color(s) orange, dark orange, and gray are claimed as a feature of the mark.”; and

 

(2)     Color location statement:  “The mark consists of the color(s) orange, dark orange, and gray, with the color orange appearing in a stylistic representation of the Golden Ratio formed by multiple curved shapes in a spiral pattern, the color dark orange appearing in parts of the curved shapes, and the color gray appearing in the wording PHI.”
