DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by TMEP §718.02(a), the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Applicant did not respond to the previously issued Office action within six months of the date of issuance of the action.  The outstanding refusal(s) and/or requirement(s) applied to only a portion of the application.  Therefore, a portion of the application is abandoned.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a); TMEP §718.02(a). 

 

The application will proceed with the following identification: 

 

International Class 38:  Electronic transmission of voice, data and images by television and video broadcasting; Video-on-demand transmission services; Video-on-demand transmission services via the Internet; Broadcasting of television programmes; Satellite television broadcasting; Pay-per-view television transmission services; Communication services, namely, transmission of voice, audio, visual images and data by telecommunications networks, wireless communication networks, the Internet, information services networks and data networks; Information transmission services via digital networks  

 

The remaining portion of the identification that was the subject of the partial refusal(s) and/or requirement(s) will be deleted from the application, specifically, International Class 45 in its entirety.
