SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
1. Comparison of the Trademarks
Applicant seeks to register SPECIAL OPS (standard characters), while the registrant owns and uses the mark SPECIAL OPERATIONS WARRIOR FOUNDATION (stylized with design).
If the marks of the respective parties are identical or highly similar, the examining attorney must consider the commercial relationship between the goods or services of the respective parties carefully to determine whether there is a likelihood of confusion. In re Concordia International Forwarding Corp., 222 USPQ 355 (TTAB 1983).
2. Relatedness of the Goods
If the goods and/or services of the respective parties are “similar in kind and/or closely related,” the degree of similarity between the marks required to support a finding of likelihood of confusion is not as great as would be required with diverse goods and/or services. In re J.M. Originals Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73 USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b).
Here, applicant seeks to register its mark for “shirts, tank tops, tee-shirts, sweat shirts, sweat bands, sweat pants, coats, shorts, skirts, undergarments, underwear, belts, pants, jeans, hats, caps, scarves, gloves, suspenders, socks, jackets, vests, coveralls, overalls, ski-bibs, shoes, boots, sandals, rain coats, rain suits, and ponchos,” while the registrant uses its mark on, inter alia, “T-shirts, polo shirts and baseball caps.” Given the identical and related nature of the goods and the similar commercial impression of the marks themselves, there is no doubt that consumers encountering both trademarks will assume that the goods come from the same source.
