Search Results – No Confusingly Similar Marks Found

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

Identification of Goods

 

Portions of the identification of goods are indefinite and must be clarified as indicated below.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses. 

 

Applicant may adopt the following identification, if accurate:   

 

International Class 10:  Medical fluid temperature management devices and disposable fluid administration sets and accessories; medical patient temperature management devices and accessories; patient warming blankets; medical warm air blowers; medical conductive warming mattresses; Foley catheters; urine meters; temperature probes; esophageal stethoscopes; myocardial probes

 

Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Description of the Mark

 

Applicant must submit an accurate and concise description of the literal and design elements in the mark.  37 C.F.R. §2.37; see TMEP §§808 et seq.  The following is suggested, if accurate:

 

The mark consists of the wording LEVEL 1 in the color white placed inside an orange colored quadrilateral with two rounded corners.
