In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
In this case, the applicant’s proposed mark is extremely similar to the registered mark. Applicant’s SUN SMART and design and registrant’s SUN SMART share appearance, sound, meaning and commercial impression. Moreover, the attached evidence shows that the goods are of a type which can emanate from one source. Purchasers encountering these products in the marketplace would likely mistakenly believe that the goods all emanated from one source. Because source confusion is likely, registration must be refused under Trademark Act Section 2(d).
