This Office action is in response to applicant’s communication filed on September 25, 2009.  the applicant (1) argued against the refusals to registration under Sections 2(e)(1) and 2(a), (2) claimed acquired distinctiveness, (3) claimed ownership of a prior registration, (4) amended the classification of services and (5) provided the state of incorporation.  Only Nos. 1, 3, 4 and 5 are fully acceptable.

 

Disclaimer

 

If applicant amends the application to seek registration on the Principal Register under Trademark Act Section 2(f) or on the Supplemental Register, applicant must disclaim “FOUNDATION” because such wording appears to be generic in the context of applicant’s goods and/or services.  See 15 U.S.C. §1056(a);  In re Wella Corp., 565 F.2d  143, 196 USPQ 7 (C.C.P.A. 1977); In re Creative Goldsmiths of Wash., Inc., 229 USPQ 766 (TTAB 1986); TMEP §1213.03(b).

 

The following is the accepted format for a disclaimer:
