The assigned examining attorney has reviewed the statement of use filed on 4/20/10 and has determined the following.

 

 

SPECIMEN REFUSAL

 

The specimen is not acceptable because it is too small to show the mark in detail.  Specifically, it is too small to see the flame design in the letter “O” in “MOLTON,” so it therefore does not clearly show the applied-for mark in use in commerce.  A statement of use must include a specimen showing the applied-for mark in use in commerce for each class of goods specified in the statement of use.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.56(a), 2.88(b)(2); TMEP §§904, 1109.09(b). 

 

Therefore, applicant must submit the following:

 

(1)  A substitute specimen showing the mark in use in commerce for each class of goods specified in the statement of use; and

 

(2)  The following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: The substitute specimen was in use in commerce prior to the expiration of the deadline for filing the statement of use.  37 C.F.R. §2.59(b)(2); TMEP §904.05; see 37 C.F.R. §2.193(e)(1).  If submitting a substitute specimen requires an amendment to the dates of use, applicant must also verify the amended dates.  37 C.F.R. §2.71(c); TMEP §904.05.

 

Examples of specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale.  See TMEP §§904.03 et seq.

 

Alternatively, applicant may simply submit a better, larger version of the existing specimen.  Such a submission would not require a new declaration.  The Class 25 specimen is acceptable.

 

Pending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a trademark.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.56(a), 2.88(b)(2); TMEP §§904, 904.07(a).

 

Applicant may not withdraw the statement of use.  37 C.F.R. §2.88(g); TMEP §1109.17.

 

 

THIS REFUSAL APPLIES TO CLASS 9 ONLY

 

If applicant does not respond to this Office action within the six-month period for response, then International Class(es) 9 will be deleted from the application and the application will proceed forward for International Class(es) 25 only.  37 C.F.R. §2.65(a).
