The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based.  TMEP §§716.04, 716.05.  Applicant will be notified when suspension is no longer appropriate.  See TMEP §716.04.

The effective filing date of the pending application(s) identified below precedes the filing date of applicant’s application.  If the mark in the referenced application(s) registers, applicant’s mark may be refused registration under Section 2(d) because of a likelihood of confusion with that registered mark(s).  See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, action on this application is suspended until the earlier-filed referenced application(s) is either registered or abandoned.  37 C.F.R. §2.83(c).  A copy of information relevant to this referenced application(s) was sent previously.

REFUSAL(S)/REQUIREMENT(S) CONTINUED AND MAINTAINED:  The following refusal(s)/requirement(s) is/are continued and maintained:

 

  1. The conditional refusal based on the specimen.  Although the submitted specimen would be acceptable, it is not properly supported by a declaration.

 

  1. The requirement for an acceptable identification of services.  The amended application still contains unacceptable phrases, such as “entertainment services relating to computer and video games” and “provision of on-line entertainment,” which do not clearly and adequately describe the exact nature of the services in the application.

 

The examiner again notes that prior pending application SN 76634228 has registered and may be cited against the applicant’s mark, depending on the final resolution of applicant’s identification.

 

Applicant hereby accepts the consent agreement submitted and removes Serial No. 77397056 as a potential bar to registration of applicant’s mark.  The examiner is not able to remove any other prior pending applications as applicant’s identification still contains such broad language that the examiner is unable to say with confidence that the marks could not pose a bar to registration of applicant’s mark.
