This action responds to applicant’s communication dated February 22, 2009.
The examining attorney finds the applicant’s arguments unpersuasive. The Section 2(d) refusal is continued and made FINAL.
SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
Taking into account the relevant du Pont factors, a likelihood of confusion determination in this case involves a two-part analysis. The marks are compared for similarities in their appearance, sound, connotation and commercial impression. TMEP §§1207.01, 1207.01(b). The goods and/or services are compared to determine whether they are similar or commercially related or travel in the same trade channels. See Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002); Han Beauty, Inc. v. Alberto-Culver Co., 236 F.3d 1333, 1336, 57 USPQ2d 1557, 1559 (Fed. Cir. 2001); TMEP §§1207.01, 1207.01(a)(vi).
The Marks
The marks are identical. The marks are TRAVELER.
The Goods/Services
The applicant’s goods are invalid lifts. The registrant’s goods are invalid wheelchairs. These goods commonly emanate from the same source. In addition, they are found in the same channels of trade.
The examining attorney previously attached third-party registrations showing that the goods may emanate from the same source. In addition to that evidence, attached is internet evidence showing that the goods are related and travel in the same channels of trade. For example, rehabilitaton equipement suppliers such as SpinLife.com, Monroe Wheelchair, and Planet Mobility, all offer wheelchairs and lifts.
Applicant’s argument
The applicant argues that the purchasers of these products are sophisticated purchasers such as hospitals and nursing homes. The applicant states that it is unlikely that such consumers would confuse the source of the goods. The examining attorney respectfully disagrees. As shown above, both invalid lifts and wheelchairs are manufactured by or sold by the same entity. A consumer seeking to purchase the invalid lift is likely to encounter the same mark on wheelchairs offered by the same manufacturer or retail outlet. Further, the fact that purchasers are sophisticated or knowledgeable in a particular field does not necessarily mean that they are sophisticated or knowledgeable in the field of trademarks or immune from source confusion. TMEP §1207.01(d)(vii); see In re Decombe, 9 USPQ2d 1812 (TTAB 1988); In re Pellerin Milnor Corp., 221 USPQ 558 (TTAB 1983).
Given the identical marks and the related goods, confusion as to source is likely and therefore, registration is refused under Trademark Act Section 2(d) based on a likelihood of confusion. This refusal is made FINAL.
Response to Final Action
(1) Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or
(2) Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
