The Office records have been searched and there are no similar registered or pending marks that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.

 

Identification

 

The identification “Medical device for removal of skin tags” is indefinite and must be clarified because it is not sufficiently precise.  See TMEP §1402.01.  The identification of goods is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses.  Is the device considered a surgical device?  Is it electronic or mechanical?  Does the device use laser technology to remove the skin tags?

 

 

Applicant may adopt the following identification, if accurate:  ELECTRONIC MEDICAL SURGICAL DEVICE FOR LASER REMOVAL OF SKIN TAGS in International Class 010.

Proper classification of goods and services is a purely administrative matter within the sole discretion of the United States Patent and Trademark Office.  In re Tee-Pak, Inc., 164 USPQ 88, 89 (TTAB 1969).

 

Identifications of goods and/or services can be amended only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

Applicant must submit explanatory or promotional materials to permit proper examination of the application.  See 37 C.F.R. §2.61(b); TMEP §§814, 1402.01(e).

 

Failure to respond to a request for information can be grounds for refusing registration.  TMEP §814; see In re DTI P’ship LLP, 67 USPQ2d 1699, 1701-02 (TTAB 2003).  Merely stating that information about the goods or services is available on applicant’s website is an inappropriate response to a request for additional information, and is insufficient to make the relevant information of record.  See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004).
