THIS IS A FINAL ACTION.
This Office action is in response to applicant’s communication filed on August 29 2008.
The substitute specimen requirement has been satisfied and is now withdrawn. However, the requirement for a statement regarding the significance of the wording in the mark is now made final.
STATEMENT REGARDING SIGNIFICANCE OF WORDING REQUIRED
Applicant must explain whether “TORC” has any meaning or significance in the industry in which the goods and/or services are manufactured/provided, or if such wording is a “term of art” within applicant’s industry.
Failure to respond to this request for information can be grounds for refusing registration. See In re DTI P’ship LLP, 67 USPQ2d 1699, 1701 (TTAB 2003); TMEP §814.
If applicant does not respond within six months of the mailing date of this final Office action, the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond to this final Office action by:
(1) Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or
(2) Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
