The following explanation of excusable nonuse has been made of record: Nonuse of the SANDS (Stylized) mark in connection with the goods in Class 9, specifically "Decorative magnets; automatic teller machines (ATM); cases for spectacles and sunglasses; contact lens cases; gaming machines that generate or display wager outcomes; gaming machines, namely, electronic slot and bingo machines; machines for playing games of chance" is due to special circumstances surrounding COVID-19 related closures and restrictions which prevented Registrant from operating its hotel and casino properties from which it offered for sale these goods, and challenges related to production of the same given the pandemic. Registrant's properties were shut down on March 18, 2020. Registrant will restock the pertinent goods when it is clearer that its properties from which it sells the goods can open to the public at full capacity without risk to the public's health and safety. The nonuse is NOT due to an intention to abandon the mark. Registrant is expected to reopen, restock, and resume use when the Coronavirus is better controlled for reinstatement of offering goods for sale in person.
