Date of First Use Anywhere Interpreted as Later than Date of First Use in Commerce
Therefore, applicant must amend the dates-of-use clause to specify a date of first use anywhere that is not later than the date of first use in commerce. If the amended date of first use anywhere differs from the date of first use in commerce, applicant must verify the amended date of first use anywhere with an affidavit or signed declaration under 37 C.F.R. §§2.20, 2.33. See 37 C.F.R. §2.71(c); TMEP §903.05. However, if applicant adopts the date of first use in commerce as the date of first use anywhere, applicant need not verify the amendment. TMEP §903.05.
