PLEASE NOTE: Applicant is encouraged to e-mail the trademark examining attorney to resolve the issues raised below at Bill.Dawe@uspto.gov. Before the application can be considered further, the following informal issues must be addressed.
IDENTIFICATION OF GOODS
The wording “plant nutrients, especially for organic crops” in the identification of goods is indefinite and must be clarified because it does not put consumers on notice as to the precise nature of the applicant’s goods. See TMEP §1402.01. Applicant may substitute the following wording, if accurate:
Class 1 – plant food for organic crops, namely, plant nutrients
For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
Applicant must specify whether “OIKOS” has any significance in the trade or industry, any geographical significance, or any meaning in a foreign language. 37 C.F.R. §2.61(b).
